Louboutin Vs. YSL: Battle Of The Red Sole

Louboutin lover or not, we all associate the red sole with the designer. But this week a US Federal Judge denied Christian Louboutin’s SA request to stop sales of red soled shoes from rival YSL’s 2011 cruise collection. The reason? They stated that it is unlikely that Louboutin would not be able to prove that its very own soles deserve trademark protection. Although the designers very well-known red soles are protected by an award from the US Patent and Trademark Office in 2008, YSL still featured shoes with shades of red on the soles. This caused Louboutin to file a suit and asked for a preliminary injunction to prevent YSL from selling these particular shoes while the suit was pending.
Now that this has been denied, does this mean the famous red lacquered sole will be seen a lot more? And by who? I can’t help but feel a little disheartened by a potential non-Louboutin red bottom. Well, the battle continues as both fashion houses have been ordered to be back in court next week.
