Louboutin Vs. YSL: The Saga Continues

Last summer you may recall a little issue surrounding the ‘Battle of the Red Sole’, where Louboutin
iconwas denied a trademark on those much coveted red lacquered soles that grace the feet of many a shoe lover. YSLicon, who featured shoes with red soles as part of their Resort collection last year, have now hired 11 law professors who specialise in trademark law in their defence against Mr. Louboutin in a saga that doesn’t seem to be ending anytime soon. A brief was filed on Tuesday against Louboutin and its quest to protect the use of the red colour citing there should be freedom of innovation and competition.

“A woman who buys red shoes is doing so for a reason – red shoes have a particular meaning to her, and to others, that cannot be supplied or even approximated by shoes of a different colour. Given the substantial creativity involved in both fashion design and fashion consumption, courts should not lightly allow one particular competitor to monopolise particular fashion submarket.”Legal experts in YSL’s defence.

Louboutin didn’t win round one in August. Let’s see how this one pans out..
